If child maintenance cannot be agreed, you can apply to the Child Maintenance Service for a maintenance calculation. In some circumstances applications can be made to the Court.
In Divorce or Dissolution of Civil Partnership
In addition to advice and negotiations, if agreement cannot be reached the Court, dependant on the circumstances, can make orders for:
Transfer of Property;
Maintenance for former Partners;
For Children: Maintenance; School Fees Orders and Lump Sums.
In addition to advice and negotiations, if agreement cannot be reached the Court, dependant on the circumstances, can make orders using the Trusts of Land and Appointment of Trustees Act 1996 to resolve ownership of property and if there are children the court can consider lump sums, transfer or property, maintenance and school fees orders using Schedule 1 of the Children Act 1989.
